Abstract:
This article discusses a brief history of building codes, and how building codes legislate the practice of structural engineering. It also addresses the ramifications of building code interpretations by judges in construction defect litigation, and the resulting risk to all parties involved in the construction project, including design professionals, contractors, and material suppliers. An actual case is cited which demonstrates the issues raised. In the cited case the judge’s interpretation of the building code was radically different from the way the code had been consistently interpreted in actual practice for decades. Recommendations are made for remedial measures.
